About this charge
Failing to stop under section 320.16 is a criminal offence distinct from its provincial cousin: the Crown must prove that you knew, or ought to have known, of an accident and failed to stop, give your particulars, and offer assistance. Causing bodily harm or death elevates it to a straight indictable offence carrying maximum penalties of fourteen years and life respectively.
