Immediate Roadside Sanction: FAIL
About this charge
IRS: FAIL applies where a driver is at or over the criminal blood-alcohol or drug limit, or refuses testing. On a first occurrence it brings an immediate licence suspension followed by a lengthy interlock-restricted period, a monetary penalty, vehicle seizure, a mandatory remedial course, and steep insurance consequences, all without a criminal charge, and all beginning at the roadside. Penalties escalate sharply with each occurrence. You have seven days from the Notice of Administrative Penalty to file a review.
