Immediate Roadside Sanction: WARN
SafeRoads Alberta & Immediate Roadside Sanctions
About this charge
IRS: WARN applies to a blood-alcohol concentration in the 0.05–0.079 range. A first occurrence brings a short suspension, vehicle seizure and a monetary penalty; repeat occurrences escalate and add a remedial course. As with FAIL, the seven-day review deadline is strict, and paying the penalty is treated as accepting the contravention.
How we defend it
- Do not pay before taking advice; payment accepts the contravention
- Seven-day deadline from the Notice of Administrative Penalty
- Procedural and reliability grounds reviewed on the record
