Provincial Traffic Offences

About this charge

Alberta's stunting provision captures any stunt or activity on a roadway “likely to distract, startle or interfere” with other road users, language broad enough to reach conduct that was never dangerous. The fine is $852, with demerit points and an insurance consequence on par with careless driving. Because officers can choose which version of the charge to lay, the first question is whether the charge actually fits the conduct. Often it does not.

How we defend it

  • Test whether the conduct falls within the provision at all
  • Challenge the characterisation where a lesser charge fits the facts
  • Assess the insurance consequence before any resolution
